Mr. Kanth reported: there is no indication for engaging the Youth Office, since the children are “happy and content” …therefore, an intervention may not be justified.

…Mrs. Rieser speaks about the deprivation of custody to be decided by the Family Court. According to Mr. Wittman this would be feared the most. However the Department of Justice doesn’t see any chance and because of the judicial independence there would be no way to give directive.

Expert Opinion concerning compliance with the compulsory vocational education at the Supplementary School of the association Gemeinschaftsschule in Klosterzimmern e.V. of July 26th, 2006.

At the Supplementary School in Klosterzimmern the youth who must meet the compulsory vocational education are being trained according to JoA ( vocational school-age youth without training course) just as they would be at public vocational school.

Enclosed we send the comments of the State Office of Education Donau-Ries as well as the SG41 of the Government concerning raised questions regarding sector Primary school and vocational school. From this it can be seen, that the terms of KMS 2006.09.07 are being kept, that there are findings on the current educational performance of the students indicating that the instructional obligations are taken seriously and without objection that so far the school inspection was always given the opportunity to make findings on the performance.

Interim report on the agreement of the Department of Culture with the Community of Believers “Twelve Tribes” on January 15th, 2007:

…the sector vocational school has been checked two times by the Government of Schwaben, in the sector Primary and High School there were 9 school and lesson inspections carried out by the State Office of Education Donau-Ries respectively by a Counseling Rector.

…All previously performed inspections concerning performance level in the sector Primary and High School for the subjects Mathematics, German and English revealed that the students mainly had average to good results, in the subject English even very good performances.

…Altogether it can be noted that the school has so far met the requirements and conditions of the decision of the State Ministry of Education and Culture of Sept.7th, 2006 without any restrictions.

Subject: Child Abduction of the Twelve Tribes children in Klosterzimmern

Dear Herr Commissioner Rößle,

NaturInRain2009In the “Nature of Rain 2009″ garden show I supervised the info–center, and on this occasion were also some people from the Oberndorf site. In this and on other occasions, I learned that you were very popular as mayor, as a district administrator (county chief), I’ve heard less.

I run a specialty nursery in O …. that is well known in Europe. Several times it has been presented on TV (Bayern 3). We have been involved in about 20 garden shows like Rain am Lech.

For me as a family man it does hurt when parents have their children taken away. I find the removal of the children of the Twelve Tribes not justified, and it has lasted for more than a year now.

The reasons for my perspective I will explain in this letter.

On September 4, 2014, I was at a public event at the Hotel Krone. The peaceful testimonies by some of the concerned youth touched me and led me to write this letter. People behaved in their time of need in an exemplary fashion — and without hatred. As you can imagine, being a parent, it is unbearable, certainly, when their children are taken from them!

Here are a few reasons that speak to me to give the children back to the parents. 

  1. The children want to return to their parents because they feel safest there.
  2. In children no abuse was found.1
  3. The children are in a good and healthy general condition.
  4. There is no danger for the children when they come back to the parents.
  5. In the broadcast on RTL, the children were punished with a rod, but no child was crying for real pain (which would sound different).
  6. RTL made dubious cuts of the scenes afterwards, [not showing] that the children were then taken and comforted in the arm.
  7. Once I was on a courtyard party in Klosterzimmern. On this occasion, I had only seen happy and well-behaved children. If all the children behaved so well in the country, your [job would  be] lighter (which you certainly would prefer) as District Administrator.
  8. If this high and senseless standard were applied to all children, then the Jugendamt (Social Services) would need a lot more workers. Also, they would need more children’s homes and workers.
  9. The removal of the child, in my opinion, is not in the child’s welfare, as indicated.
  10. The children suffer from the very situation and are bullied by other children as “cult children”.
  11. In Germany there is no collective punishment. So can a child be deprived of his parents because of belonging to a faith community.2
  12. Parents always make mistakes in the upbringing of children, but why is a child deprived of parents?

Mr. Commissioner, you have the delegated authority that allows you to take the role of a mediator in this case. Please seek discussions with the parents and provide them with social services. I hope for a sensible solution for all involved, especially for the children.

Just a note:

I and my family are not among the Twelve Tribes, and I have not punished my children if they say they are not tired. But as a father I know the kids say they are not tired when they are very tired. Letters like this are not my passion and I see myself in the rarest cases prompted so as to write here.

  2. In late 2013, our lawyer asked a very pertinent question of the German Constitutional Court. And it seems to have had an effect on the lower courts, because all of a sudden three of our youth were released. This was his question: “What this court has to decide is whether a youth, with nothing against her, can be taken from her parents, with nothing against them, simply because of their religious beliefs. Such a thing has not happened in this country since the dark days of the world war… and may it never happen again!” And it raises the legal issue of clan-guilt, known by the ugly German name of sippenhaft. And his question deals squarely with the gross illegality of the September 5, 2013 raid on our communities. Guilt is individual, not communal. We were all deemed guilty by association with one another. How tragic will be the consequences of this egregious (conspicuously and outrageously bad or reprehensible.) violation of human rights remains to be seen. ↩

How to help 

Yes, you can very well do something for the children!

“Constant dripping wears away the stone!”

Many compassionate friends, relatives and acquaintances have turned to various authorities and agencies to help us in the face of our current tragedy with our children. Anyone can help and any help is needed, and it is not insignificant.

If you enjoy writing, you can write letters to one or all of the following authorities. One can sometimes already clear express his opinion with 3 sentences.  Do not think, “I can not change anything anyway“! Please do not be silent; talk to your neighbors or friends about  it! 

So if you want to write an opinion in favor of our children, below can be found after the addresses of the newspapers (only examples) and the decision makers at various levels. You can write something about individual families you know personally and/or for the community at large. We would be happy about it, get a copy of your letter and if you agree (please clearly tell), we would publish your letter with your initials on our website, as often letters to the editor have simply not been published when they in our favor.

Note that the families in Klosterzimmern were divided between two judges, splitting the alphabetical listing of their last names in half. . . and not simply equally dividing the whole group into two equal or nearly-equal sizes. So one judge had one family and the other judge had ten families. It’s baffling why this was done, but the effect of it was to keep some parents from their children for a long time, because the parents could not see their children, typically, until after the case had come up in court.

That “past” is NOW!

The following was written to our German website in January, and forwarded to us just now. The author contemplates the connection between the past and present in his beloved country of Germany and finds the connection rather strong, much to his dismay…

As an uninvolved non-religious person, I follow from northern Germany the events surrounding the “Twelve Tribes” for months. Anyone well-informed and with common sense and above all has decency must come to the realization that to these people a huge injustice is being done.

The first and foremost victims of this huge injustice is to the “saved” (as pretended) children themselves. Everything was taken from them: their undoubtedly loving and beloved parents, their beautiful living environment, their community, their friends, and even their siblings have these brutes taken from them by having them isolated from each other.

And all this despite the facts clearly refuting the allegations against the “Twelve Tribes”. Here again only two quotes about this:

“After the allegations of ill-treatment stated by drop-outs, the health office staff have examined the children of the community of faith ‘Twelve Tribes’ in Klosterzimmern. The result:

CountyChief_Stefan_RoessleAccording to the district administrator Rieser Stefan Rössle were discovered no external injuries.’ ‘There were no abnormalities found in the children, no psychological problems‘, so Rössle said on request of our newspaper.

But there are still many, many, more proofs.

It is so easy to see that these children there live a good life that most other children can only dream of. The “Twelve Tribes” are the living proof that corporal punishment does NOT cause damage if it is done in moderation and embedded in a loving upbringing, and this is at the “Twelve Tribes” is obviously the case.

This absolutely outrageous actions of the authorities concerns each of us. If we do not take action against this madness, then many of us will think in the not too distant future:

When they picked up the children of the community, “The Twelve Tribes”, I did nothing,
because I was not a member of the “Twelve Tribes”.

When they picked up the children of Jehovah’s Witnesses, I did nothing,
because I was not a Jehovah’s Witness.

When they picked up the children of the anti-vaccination people, I did nothing,
because I was not anti-immunization.

When they picked up the children of vegans, I did nothing,
because I was not a vegan.

But when they came for MY children, I wished very much I would have done something then.

My fellow citizens, this “past” is NOW!

On this day, we, the affected families from Klosterzimmern, filed a disciplinary complaint with district chief Rößle against the responsible employees of the Jugendamt (Youth Office) on suspicion of serious criminal offenses in connection with the removal of our children and demanded immediate suspension of these employees.

Likewise, today, because of this suspicion, we will make criminal charges and indictments against the responsible employees of the Jugendamt of the district of Donau-Ries to the Augsburg prosecutor.

This involves the following allegations:

On September 5, 2013 in Klosterzimmern, all 29 children that were found there were taken under threat of physical coercion in state custody, managed in the District Office and held there.

gericht-amtsgericht-3In the process 11 children were taken in care for which there were no decisions of the district court Nördlingen. This is more than a third of all children. We and our children were herded like animals.

These children were placed under the responsibility of the Jugendamt against their will in the District Office and held there for several hours.

This constitutes the offense of false imprisonment – the deprivation of their liberty. Since there were no judicial decisions about them, this deprivation of liberty was not justified.

Other legal bases according to Code of Criminal Procedure or under SGB VIII were not available.

Coercion and Abuse of Official Powers

All children taken into care were examined medically Office on September 5, 2013 in the district office.

To this end, all children and youths between 12 and almost 18 years of age had to undress down to their underpants and show also the naked buttocks.

The investigation showed that no signs of ill-treatment could be determined by the medical officer.

For these studies, in which all children and young people were forced to undress down to their underpants and show even the bare buttocks, there was no legal basis.

This behavior, coercion under § 240 of the Criminal Code, is moreover a very serious matter because the offender has abused his powers or his position as a public official, and thus can be a criminal offence.

Reading our Mail, Violating our Privacy

The Jugendamt directed – on the basis of both written evidence and testimony – that all the letters of the children to their parents be opened and read, and that all the letters of the parents to the children be opened and read. This arrangement involved children of all ages, including young people between 12 and almost 18 years of age.

The children’s homes and foster families proceeded according to this instruction in which the children were housed apart from their natural families. Also all the letters of the parents to their children were opened, even copied by an employee in particular and stored to a file. Thus, the facts of the case are, so to speak, put on record. This measure was discontinued only after seven weeks. In the case of one employee letters of the parents were not passed on to the children, and neither did she return the letters back to the parents.

These actions constitute offenses, such as § 202 of the Criminal Code, § 206 Section 4 of the Criminal Code, and also violate the right to privacy under Article 10 of the Basic Law, optionally at retention of letters, also the crime of unfaithfulness. Justifications are not apparent. In particular, no court had ordered the inspection of letters and phone calls.

Physical Violence against our Children; Deprivation of Liberty

Multiple times children ran away from foster care and children’s homes and were returned under use of physical force by members of the Jugendamt there.

The use of physical violence against children requires a court order. Such an order did not exist. There have been several confirmations of this unique legal situation in proceedings at the Higher Regional Court of Munich, amongst others, with reference to a decision of the BayObLG of 4/27/1979 (Rb 3 Z 28/79, FamRZ 80, 81).

Multiple times children were locked up in children’s homes. In one case, the children were being locked in at night. In another case, a 17-year-old girl was denied for more than a week, under the threat of physical and psychological violence, to leave the home for maladjusted children at all. Custodial measures had not been ordered by the family court. This constitutes the fact of deprivation of liberty that qualifies as a crime under § 239 paragraph 3 of the Criminal Code.

Inviolability of our Homes Routinely Ignored

The Jugendamt conducted multiple searches in Klosterzimmern and in the process invaded the homes of several people.

Given the fundamental right to inviolability of the home there is a need for a legal basis for these searches. There were no judicial search warrants. Other legal bases did not exist.

Our Children the Objects of Bullying and Prejudice

In the facilities in which the Jugendamt had assigned them, affected children were bullied in many ways, slandered, abused, and insulted as Jews inter alia.

It will be necessary to consider whether these facts are a neglect of the duties of supervision by the Jugendamt and so constitute criminal offenses.

I want to go home!

The Jugendamt wants to convince me and tell me that I am doing better here in the home than at home. This is a lie! I can not live without my parents! This destroys something in my soul, when I am separated from my parents.

This also goes against the law! Because in the law it says that children have the right to live with their parents. I want to go home again. I won’t give up, as long as I am not at home.
