What does the District Court Director Nördlingen find wrong with our flyer?

This could be read in different press reports the first week of June. It was by no means our intention to offend Helmut Beyschlag. But we want to give the public the opportunity to be objectively informed. We try to bring to light the truth that the authorities are silent about. That is also why we now want to print the flyer here that enraged the director of the local court so much, so that you can come to your own judgment…

What we are posting is not a personal attack on Mr. Beyschlag but is our attempt to hold a public official accountable for his words and his actions through our freedom of speech. He has a duty to the public and the public has a right to exercise their right of free speech through the press (our blog).

The temporary court order, to take all minors of the Religious Community Twelve Tribes out of their families, was especially based on film and sound recordings, of so called “Spanking scenes”, statements of 7 ex-members witnesses, and a proposal of the head of the Jugendamt, Alfred Kanth. Due to this information they expected a real horror scenario at the raid on Sept.5,2013.

At least that is how district court director Beyschlag described it to the gathered media representatives at the following press conference in the district office. And that is how it was communicated to the public by the media. The religious community Twelve Tribes was stigmatized as the “clubbing sect”, before the parents or the children were ever heard. Instead of finding horribly abused children with bloody stripes, haematomas, open wounds etc., the only evidence they found was some rods and physically sound and healthy children. An immediate examination by an medical officer provided no evidence of a child endangerment.

Indeed this information was not passed on to the media representatives at the press conference in Donauwörth on Sept.5,2013.

After Mr. Beyschlag made such statements about an ongoing proceeding, it makes you wonder, what he said recently to our press release: “It is hard for him to understand how from non-public sessions and files, press releases could come about.”

Our press release referred to the recent decision of the Higher Regional Court, which reproved the faults of the district court Nördlingen.

A decision can be published by the concerned person at any time. Ongoing proceedings, on the other hand, should be handled with discretion to protect the affected person.

What the Higher Regional Court has to say about the District Court Nördlingen:

Considering the background of a more than 1 ½ year long separation of the child from the parents based only on a temporary regulation in an urgent procedure of the temporary order and based on the fact that in the main proceeding the taking of evidence that was already decided in December 2013 has not yet begun we see reason to indicate the following:

a.(…)

The great load of the family court which the senate is well aware of cannot be given as reason in a proceeding of the separation of children and their parents.(…)

b. The command to speedy trial in custody proceeding (…)has presently special significance because the danger has to be considered that alone through the length of the proceeding that is already more than 1 ½ years facts are created that make the return of the child to the parents more and more difficult, child and parents are being alienated and another interference into the environment of the child which could again bring the child in grave conflicts. In face of these possible consequences for the psychological development of the child the duration of the proceeding so far is alarming.

At the same time and parallel thereto the court has to immediately lead the other necessary, extensive investigations among other according to the task of the court (…) especially the hearing of witnesses for the individual present case.

So it is clear that the witnesses, that would relieve the parents, were not heard at all.

Did you know, that the legislators intended a withdrawal of custody as the very last measure, and even then only after evaluating what is better for the children, to stay with the parents or to be brought into institutions? For more than 20 months now, no proof of either physical nor mental damage on our children has been or could have been offered. That is why the proceedings are being delayed, because they are still trying to find damage that was never there. Whereas a separation of the family is always connected to severe traumatic damage.

The Raid

On September 5, 2013, all of the children from Klosterzimmern and Wornitz were just taken away. At 6 o’clock in the morning the police came and got them. They said they would bring us back in the evening and that they were supposed to take us with them for a short time. I did not want to go away from my parents and thought, “They can’t possibly do this to me.”

When we were at the Jugendamt and were being examined, the people came and were supposed to put us in foster homes (orphanages) and with foster families. That was the moment when my worst nightmare began. Me and my sisters were brought to a home. I was just weeping, and I was helpless.

Then the police said, “Tonight, you’ll be back with your parents.” As it got later and the caretaker gave us our rooms and beds, I knew that it was a lie and we’d have to stay here for a while.

I didn’t know what to do and that’s how the days went by. On every new day, when evening came, I lay in my bed and wept.

Chaninah's Raid Letter p. 1Then we were allowed to call my parents but it didn’t really help. I simply wanted to go home to my friends and family. I also counted every day – 1 week, 2 weeks, and so forth.

7 weeks had passed before I was allowed to see my parents again for the first time. They were also allowed to know where we were, but they were only allowed to see us when accompanied by the caretakers and Jugendamt, because they thought otherwise my parents would just take us. I couldn’t understand why Judge Mrs. Roser threw us all into one pot. She didn’t have any evidence that our parents beat us.

After a while we were allowed to see our parents every other week. I was very happy to see them. I didn’t understand anything. Like many puzzle pieces that didn’t fit together…

When we had a hearing at Judge Frau Roser’s court, I had a feeling that she had us prejudged already and didn’t really listen to us. At the Appeals Court, for the first time, I felt like the judge listened and tried to understand us.

I knew that even if they separated us, you could never separate a daughter from her mother or father, even if they can’t be together.

My friends and parents encouraged me saying, “If not today, then tomorrow.” That’s how we can endure, is if we encourage one another. I also know that when I am away from my family and my friends won’t ever forget me. They encourage me to hold on and not give up.

My parents are always there for me. Some children don’t have parents that care for them the way mine do. And nobody can replace my parents for me. They’ll always be the best parents in the world. I know that they love me and I love them, too.

After three months we heard that Besorah was allowed to go home. We were so happy for her but it was very hard to let her go. I would not see my older sister very often any more.

It didn’t make sense to us that she was allowed to home just cause she was older. I was always happy when all three of them visited every other Friday.

Even though we needed to be accompanied and we were never able to have our private “realm”, it was nice. Like cold water to a thirsty soul. Simply forget everything and enjoy the time as a family that we don’t have very often.

You’d felt like you were in prison, never knowing when you could go out and always having to be watched. Everyday I hope that I could go home soon.

I will continue to endure, even if I suffer. It strengthens the character.

I know that I can make it and it will have an end. I am old enough and know what I want.

Nobody can force me to do something I don’t want to do. I hope the people who read this letter will take to heart what I am trying to say.

And that they might start listening to the younger ones, because they also have something to say.

Observations of the school authorities concerning the well-being of the children of the Twelve Tribes for the Year 2013:

… The Ministry of Education and Culture considers closing the school for the coming school year. If this was the case, however, the reason for it would be a formality: The community has difficulties, to find certified teachers.

… At a meeting in the Ministry of Education and Culture on February 5th, several members of the community admitted for the first time, to discipline their children with a stick, as it says in the report of the ministry of education and culture to the Landtag (state parliament) from the end of March.

“They referred to the Old Testament”, says Alfred Kanth, leader of the responsible Jugendamt Donau-Ries, who was at the meeting. Apparently the community does not interprets the blows as abuse, but as a parental right and sign of parental love.

Closed community, no evidence

1. So far, sturdy proofs of chastening don‘t exist. Last Summer a medical officer had checked 40 – 50 children and had not found Alfred Kanthany trace of abuse, said the head of the Jugendamt, Kanth. “A few children were missing, but there wasn‘t any indication that they could have been sent away because of the checkup”. Every 4 – 6 weeks social workers were on the property. “There we experience happy, well trained children, that are attached to their parents”, says Kanth. “We have no reason to take them out of their families.”

Even the prosecuting attorney’s office in Augsburg has difficulties, to be able to convict the bible devout believers of concrete deeds. “The investigations don‘t happen easily”, says spokesman Matthias Nickolai. This was also because of the very closed community. When, or if a charge could be preferred, is not predictable at the moment.

Likewise the hands of the school supervisory are bound. Since no one of the Twelve Tribes had admitted so far, that spankings were being practiced in school as well, said Ludwig Unger.

Since 2010 none of the students have made an external certificate of Secondary Education. But this is at the discretion of the parents.

Otherwise, the students were at a good level of performance in the 
last few years. And so the lack of qualified teachers is the only 
way the authorities can address against the community and to close 
the school. But then they faced again an old problem: Where will
the children of the “Twelve Tribes” be taught from September on?

1. examination of performance in the subject German on April 11th, 2013

1.1 examination of performance in the realm “spelling”

8 of 15 assessed tests are classified above average (53%), 2 are average (13%) and 5 are below average (33%). The performances are like in the years before comparable to results in a Regular school.

1.2 examination of performance in the realm “write for yourself and others”, “write texts”

7 of 15 assessed tests are classified above average (46%), 5 average (33%) and 3 below average (20%).

Summary of results in the subject German:

Also in this examination of performance the overall results of the students are satisfactory. Approximately half of the students reached good respectively above average results in the realm of “spelling” and “write for yourself and others” / “write texts”.

In general, the specific requirements of different text types (especially in letters) were met. However, a development is necessary, especially in higher grades, in particular in the argumentative and founded writing is still, in particular with regard to structuring, structure of the argument and factual style of writing.

2. examination of the achievements in mathematics on April 9th, 2013

Summary of results in mathematics:

Out of 15 rated student tests 4 (27%) were in the above-average, 9 (60%) were in the average and 2 (13%) below average.

This time again the students were focused, working cleanly, clearly and they stayed on a clear presentation of the steps towards the solution.

3. examination of the achievements in content subjects (homeland, expertise, physics, chemicals, biology) on the April 15th, 2013

In the grades 2-4 themes from the “Explore the environment – learning field nature and technology“ or “Life with nature – learning field animals“ were presented in independent, separate presentations by each student. Afterward questions were asked and the competence of the students was reviewed. It showed that in the aspect of “knowledge / skills” the children were at least found in the average range. The subject-specific procedures (experiments, presentation techniques, illustrate the results, etc.) were dominated by the majority of the students at least satisfactory.

In my opinion, teaching students of different levels together in one class leads to either asking too little of them or too much.

In the 5th, 7th, 8th and 9th grade, the topics were presented in autonomous student presentations and verified by transfer questions.

Regarding the usual categories (construction / structure, presentation manner, illustrative manner, expertise) the presentations were at least in the average range.

The current affairs should, however, find more consideration mainly in the higher grades (for example, topics such as “radioactivity”: Discussion on repository, threat of dictatorships…).

Conclusion:

The performance review at the private supplementary school Klosterzimmern this year, was held in a friendly atmosphere again; cooperation and acceptance of the review procedure on the part of teachers could be observed again.

Dear All,

My name is Cesar Camacho, and I’m writing you from Buenos Aires – Argentina. Since August 2013, when my son Juan Pablo Camacho, decided to join the Community the Twelve Tribes of Israel in General Rodriguez Province of Buenos Aires, I learned of the existence of the Community.

They have shown at all times to be exemplary in every way. I have attended their weekly meetings, and have stayed overnight in their house, called “Menucha”. I have always been treated with respect and affection, from all: adults and adolescents and children. I found a full Peace I continue to carry on in my life.

My son, Juan Pablo, has found his place in the world, living in Community with brothers of his new life. I have visited other houses in the Community and met in all the same idea, the same meaning for life, work, respect, and love for their brothers. It’s a surprise to see how they educate their children. They are not envious of the society where all can see every day child trafficking, sexual abuse, labor abuse, etc.

No all use the Laws of the Civilized World since the Rights of the Child are often neglected.

At the beginning I had my preconceptions, and even I believed that they were a sect. Today I see that all these doubts were unfounded, and that is the best place that my son has chosen to live.

When I find out what happens to children in Germany (Klosterzimmern), I remain bewildered. It is totally unfair that they have been ripped from their parents. It is an abuse that I can not get into my head. As mature and high as the German society is, it has removed the children as criminals. They have rights and honor, and by those Rights they should return them to their homes.

I will pray and ask God to enlighten you and stop the damage, much damage, that you are causing.
